By accessing the website www.dibs.design OR my.dibs.design using the online service provided by Truecopy Credentials Pvt Ltd (“TRUECOPY”) You (the user(s)) agree to the Terms of Service as follows:
1. To the users desiring timestamp services, TRUECOPY offers timestamp services. Under this, the “Content Creators” can timestamp their creations (“Content”) which means that the user will have the option to authenticate the particular date and time of a particular content uploaded by the user on the Platform provided the upload has been made in the mode, manner and medium indicated and acceptable on the Platforms defined below (“Services”). “The user will be provided with a certificate to confirm that the content desired to be submitted has been successfully submitted by the user. The record of such submission can be accessed by conducting a scan of the QR Code which is made available in the certificate referred above.” The said certificate will further identify the email id of the user provided by the user on the Platform.
2. You agree to use the Service only for the purpose it is intended and not misuse it in any way, interfere with it in any way, or access it in any way other than via the latest or previous to latest versions of standard browsers, above website and our mobile application (“Platform(s)”).
3. Using our Service does not give you ownership of any intellectual property rights in our Services or in any of the content available on our Platforms.Any clearances, permissions, consents, and approvals to be procured pertaining to the logos, trademarks, copyrights, patents, pictures, texts, contents, etc forming a part of any uploads made by the user will be the sole responsibility and liability of the user availing the Services of the TRUECOPY (“THIRD PARTY CONSENT”). By uploading the content, the user hereby represents that such THIRD PARTY CONSENT has been procured by the user in advance (“Pre-requisites”) and the TRUECOPY is in no way responsible for any liabilities stemming from the user”s breach of the Pre-requisites and/or any failure of the user in procuring THIRD PARTY CONSENT from the rightful owners of any content uploaded on the Platforms.TRUECOPY”s rendition of Services does not indicate that we”re approving or permitting the usage of any third-party rights pertaining to logos, trademarks, copyrights, etc involved in the user”s uploaded content and the user is alone responsible to comply with the necessary Pre-requisites.
4. To regulate your use of the Service, we may send you service announcements, administrative messages, and other information, and you agree to act on those as required.
5. You agree not to upload any content that has not been created by you or any content whose ownership is in dispute or any content that is not owned by you. Submittal of Content does not by itself prove your ownership or rights to the Content. It only demonstrates your possession of the Content at the specific time. It is not a replacement “of proof of ownership of the trademarks”, copyright or patent rights involved in the matter. Truecopy hereby reserves the right to take down/reject the content or its submissions due to ownership claims, contentions raised by any third party, directive by a Government agency or if the content is objectionable including but not limited to pornography.

6. You alone are responsible for the accuracy or correctness of the data. Truecopy does not attest to the correctness of the submitted data or its origin.
7. You agree to abide by all the applicable laws of your jurisdiction. You agree not to upload content that is illegal or contrary to the laws of the jurisdiction.
8. Availability: We try to ensure the high availability of the service. However, It is possible that the service may not be available for small periods and intervals due to server inaccessibility / downtime for maintenance. We do not undertake to preserve your data for more than 10 years after it has been submitted.
9. Warranties and Disclaimers:We provide our Services using a commercially reasonable level of skill and care. These services are provided on an “AS IS” basis. NEITHER THE TRUECOPY NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.
10. Liability for our Services:TRUECOPY WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOSS OR DAMAGES OF ANY OTHER KIND RESULTING FROM THE USE OF OUR SERVICE. THE TOTAL LIABILITY OF TRUECOPY, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID TRUECOPY TO USE THE SERVICES.TRUECOPY IS NOT RESPONSIBLE FOR ANY THIRD PARTY SERVICES PROMOTED OR AVAILED BY THE USER THROUGH OUR WEBSITE BY CLICKING ON ANY LINKS OR DOWNLOADS.
11. Indemnity:By accessing the Services, the User agrees and hereby indemnifies, defends, and holds harmless Truecopy and its affiliates against any liability arising out of any third party claims, or breach of these terms envisaged in connection with the use of its Services.
12. Indirect Use:If you are using our Services on behalf of another entity, that entity needs to accept these Terms of Service. It will hold harmless and indemnify TRUECOPY from any claim, suit or action arising from or related to the use of the Services or violation of these terms.
13. Force Majeure:Neither Party can be held liable if the performance of the terms is delayed or prevented due to a case of force majeure or a fortuitous event, due to the other Party, a third party, or circumstances outside their control such as industrial disputes, intervention by civil or military authorities, natural disasters, including pandemic like Covid 19 and all of its variants, fire, water damage or poor functioning or interruption of the telecommunications network or the electricity network.
14. Invalidity:If one of the provisions of the Terms of Service is deemed invalid by virtue of a current or future legal or statutory provision, or a court ruling that constitutes res judicata pronounced by a competent court or body, that provision of the contract shall be deemed unwritten, and all of the other provisions of the present Terms of Service shall remain in full force between the parties.
15. Waiver:If one of the parties fails to exercise its rights under any of the provisions of the present Terms of Service at a given time, it cannot be deemed to have waived its entitlements hereunder.
16. Applicable Law And Court Of Competent Jurisdiction:The present Terms of Service are governed by Indian law, and only the English version is valid in order to interpret them.In the event of a disagreement resulting from the performance or interpretation of the provisions hereof, the Parties must meet to try to find an amicable settlement to their dispute, before referring the matter to the competent court.If they fail to reach a settlement, the Mumbai courts will have sole jurisdiction over the dispute.
17. Miscellaneous Provisions:
a. Truecopy reserves the right to unilaterally change the present Terms of Service, in particular in case of technical developments, changes in the law or case law, or the introduction of new services.
b. The new terms will govern all future relations between the parties, only the new version shall prevail between them, and the applicable conditions are always those that are available online on its website.
c. The User is therefore requested to regularly consult the latest version of the Terms of Service which is permanently available on its website.
d. All of the new functions, improvements, and additions to all or part of its website and the Service are subject to the present Terms of Service.
18. The authentication and the certificate provided to the user in respect of the contents uploaded on the website shall not be valid if:
a. If the content for which authentication or certification has been provided is altered after uploading in any manner
b. If the certification provided, the QR code provided, time spam provided is altered in any manner
c. If the content provided is proved to be ownership of any other person other than the uploader / user
